NAPW and Community Legal Services (CLS) submit amicus brief in Pennsylvania’s highest court

In May 2018, NAPW and Community Legal Services of Philadelphia (CLS) submitted an amicus curiae (“friend of the court”) brief in the case of In re L.B. In this appeal, the Pennsylvania Supreme Court is reviewing whether giving birth to a substance-exposed infant can support a child abuse finding against the new mother.

NAPW’s and CLS’ amicus brief highlights the negative impacts such a ruling would have on mothers and children, including the public health perspective and risk such policies have of deterring women from obtaining needed treatment and support. The brief also highlights the need to avoid lifelong stigma and support pathways out of intergenerational poverty for women and children.

More than 40 medical, public health, harm reduction and advocacy groups signed on to our brief, including American College of Obstetricians and Gynecologists (ACOG); The American Medical Association (AMA); Pennsylvania Chapter, American Academy of Pediatrics; and the Pennsylvania Medical Society.
